Some of the 167 workers picketing to protest the failure of their employer to contribute to the Employees Provident Fund.
The Employees Provident Fund (EPF) said its investigation revealed that Recycle Energy Sdn Bhd had defaulted in its EPF contributions between 2012 and 2014.
EPF head of corporate affairs Nik Affendi Jaafar, in a statement, said two civil suits had also been filed against the employer and its company directors.
However, both civil suits had been postponed to be mentioned on Oct 30 and Nov 27.
“The EPF will make every effort to recover all outstanding contributions for the employees.”
The recycling company in Kampung Pasir Baru, Semenyih, which operated waste and recycling management for the Hulu Langat district, was thrust into the limelight following a picket by 167 of its employees recently.
The picket, held with assistance from Parti Sosialis Malaysia (PSM) over unpaid salaries since May in addition to the missing EPF contributions, was reported by The Rakyat Post.
The employees also claimed that they had not been paid overtime allowance for a year.
They filed a court order at the Labour Department with the department issuing an order on Sept 17 ordering the factory to pay their salaries, but to no avail.
They have threatened to hold a picket in Putrajaya should the factory’s management continue to remain silent on the matter.
Under the EPF Act 1991, Nik Affendi explained, all employers are obliged to submit their monthly statutory contributions on behalf of their employees on or before the 15th of the month.
“The EPF reminds employers that EPF savings is an important source of income for employees’ retirement and the Fund will not hesitate to take firm action against employers and company directors who fail to remit their employees’ monthly EPF contributions.”
